Terms and conditions 2012
The rental fee includes the holiday home with inventory and accessories, together with water and refuse collection charges. Utility charges incurred must be paid according to usage, on departure.
The holiday home must not be occupied by more people than the number stated in the rental agreement.
The erection of tents and/or the parking of caravans within the grounds of the holiday home is not permitted.
When the rental agreement has been entered into, ESMARCH will forward the rental certificate to the tenant. The agreed rent is to be paid as follows: first instalment, 33% of total, to be paid within 7 days of booking. The balance to be paid at the latest, 60 days before arrival. Alterations or amendments to bookings (within the same calendar year) are free up to 90 days before the rental commences. The tenant can cancel the booking, in writing, at any time, subject to the following charges:
Up to 90 days before arrival - 20% or the total rental amount
Up to 60 days before arrival - 50% of the total rental amount
Up to 30 days before arrival - 70% of the total rental amount
Up to 15 days before arrival - 90% of the total rental amount
Less than 15 days before arrival - 100% of the total rental amount.
A cancellation is considered as having been made on the day that Esmarch receives the cancellation in writing.
We do not offer cancellation insurance, but recommend that tenants take out their own insurance to cover loss of rental fees due to eventualities such as sickness etc. Such insurance should be taken out within 8 days of entering into the rental agreement.
The tenant has a responsibility to treat the holiday home with respect, and to ensure that the house is left in a clean and presentable condition on departure. A deposit may be required which will be returned to the tenant within 14 days of departure, subject to the house being left in a satisfactory condition. Tenants are responsible for any damage to the property and contents, and are liable for the costs of any replacements or repairs that may be necessary to the house or contents. Any damage occurring during the tenancy must be reported to Esmarch Holiday Homes. Neither the owner of the house, or the rental agency has any liability to the tenant during the rental period. No insurance is taken out for the tenant or the property. The rental agency functions as an agent for the properties described in the catalogue, and all information therein is accurate to the best of our knowledge. Any fault or deficiency in the property must be advised to Esmarch immediately. No claims for faults or deficiencies will be accepted after the end of the rental period.
Please note if you have booked a final cleaning (including free cleaning), that cleaning of the stove, cooker, microwave, and dish-washer is not included.
COMPLAINTS: In the unlikely event of there being any complaint about a rented holiday home, this must be advised to ESMARCH immediately, within ESMARCH'S normal opening times. ESMARCH will try to rectify any problem as soon as possible. Any complaints about the cleanliness of the rented house must be advised to ESMARCH upon arrival, and before moving into the holiday home. ESMARCH will arrange additional cleaning of the house as soon as possible. Please note that tenants arriving outside our office opening hours are deemed to have renounced any right to make complaints about house cleanliness.
In the event of price increases, increased taxes and charges, or changes in exchange rates, Esmarch holiday Homes is entitled to increase the rental price accordingly, if clearly documented. In the event of fire, war, strikes, natural disasters, etc then the landlord may cancel the rental agreement without notice.
Esmarch Holiday Homes does not own the properties, but functions only as an agent between the tenant and the owner of the holiday home. Any legal disputes concerning the rental will be settled in the courts in Herning, Denmark.
